
The National Environment Management Authority (NEMA) has threatened to shut down 107 bars and clubs across Kenya for failing to curb noise pollution.
The agency said it has received numerous complaints from residents about loud music emanating from entertainment spots including bars, lounges, and restaurants, prompting the crackdown.
According to NEMA, many of the implicated venues have already been served with Environmental Restoration Orders (EROs) but have not complied.
The agency has now given the establishments seven days to submit several regulatory documents, including their certificate of incorporation, directors’ list, Environmental Impact Assessment licence, current environmental audit, evidence of noise control measures, and justification for why they should not be subjected to legal action or forced closure.
Failure to comply will expose the businesses to legal ramifications, potentially leading to their closure.
NEMA is acting under the Environmental Management and Coordination Act (EMCA), which mandates the agency to set standards and guidelines for noise control under Section 101.
The Noise and Excessive Vibration Pollution (Control) Regulations of 2009 give NEMA authority, together with county governments and other agencies, to enforce these standards.
The directive aims to protect public health and the environment by ensuring that entertainment venues adhere to noise pollution limits.
